Symbolic elements of the legal traditions of Russian peasants in the second half of the 19th century

В статье рассматриваются обычно-правовые отношения русских крестьян второй половины XIX в., выражавшиеся в символах-знаках, символах-действиях и символах-словесных формулах. Крестьянский мир второй половины XIX в., практически изолированный от правового пространства гражданских правоотношений, урегулированных государством, оказался terra incognita для исследователей-современников. Внимание также уделено эволюции обычного права с XV до второй половины XIX в.

The article deals with the customary law of the Russian peasants of the second half of the 19th century, expressed in symbols-signs, symbols-actions and symbols-verbal formulas. Particular attention is given to the analysis of the evolution of customary law from the 15th to the second half of the 19th century. The peasant world of the second half of the 19th century, essentially isolated from the legal framework of civil law relations, regulated by the state, has turned out to be terra incognita for contemporary researchers.
